服務條款與細則


法律實體與經營名稱

本協議由客戶與在紐西蘭註冊的Kea Travel Limited(以Kiwi Explorer品牌經營)以下簡稱「本公司」共同簽署。所有以Kiwi Explorer 品牌提供之服務,在法律責任與管理上均隸屬於 Kea Travel Limited。

 

消費者保障

若客戶是以消費者身份簽署合約,且僅用於個人或家庭消費(非商業目的),將受紐西蘭《消費者保障法案 1993》(CGA) 保護。本合約不限制、否定或改變消費者受法律保障之權利。雙方同意若服務包含任何商業目的,則不受前述法案約束。

 

代理人

若本合約由代理人代簽,代理人與客戶需共同及各自為合約費用承擔責任。代理人有義務確保客戶明白並接受本合約之所有條款。

 

預訂規定

客戶需支付訂金並簽署本協議以完成預訂。尾款於行程出發日前60天付清,若未能在規定日期前完成支付,本公司保留取消該預訂且不退還訂金之權利。若預訂日距出發日不足60天,則需於預訂時支付100%全額費用。

 

付款

繳付方式包括:紐西蘭元電匯、信用卡支付。

1. 電匯:衍生之手續費如中轉手續費等均由客戶承擔。

2. 信用卡支付:額外收取 2.5% 手續費。

 

團費

若遇無法控制之旅遊成本上漲(如油價、政府稅項變更、匯率劇烈波動等)超出本公司可承受範圍,團費將可能隨成本上漲而進行適度調整。

 

取消與退款政策

1. 旅客取消:依收訖通知日期(紐西蘭時間)收取以下費用,百分比以總團費為基準

  • 出發前60天(含)以上取消:全額退費,扣除行政費 紐幣$150/人 及金流手續費。
  • 出發前30-59天取消:退還總團費之50%,扣除行政費 紐幣$150/人 及金流手續費。
  • 出發前29天(含)以內取消:恕無法退款。

 

2. 退款作業:退款時,除扣除上述行政手續費,並依付款方式處理

  • 信用卡支付:信用卡支付平台收取之手續費(依卡別約 2.9% - 3.6% 不等)由客戶自行承擔,並從本公司「實收紐幣總額」中扣除該費用。
  • 國際匯款:退款將以紐幣匯出,退款過程所產生之銀行手續費由客戶自行承擔,退款金額將以「實收紐幣金額」扣除手續費後匯出。
  • 退款金額以紐幣結算,本公司不承擔匯率差價,於收到正式取消申請後 14 個工作天內完成退款。

 

不可抗力與主辦取消

1. 不可抗力:因天災、極端氣候、疫情、航班取消等因素導致行程無法進行,本公司將協助客戶選擇延期、轉團,或申請退費。

2. 主辦取消:本公司將於出發前至少 60 天通知是否成團,若因本公司內部因素或未達最低出團人數取消,將全額退還已收費用,但不承擔旅客已自行購買之機票、簽證、保險等額外損失。

 

第三方預定

如經本公司額外代訂之住宿、租車、雪票、活動等服務,依以下規定處理:

  • 優先適用供應商條款:凡已確認之第三方預定,其取消、更動或退款將嚴格遵守該供應商(如滑雪場、飯店)之官方政策。
  • 不可退款項目:許多滑雪預定(如雪票或特定期間之住宿)為「不可退款且不可轉讓」之產品,一旦預定完成,該費用無法退還。
  • 行政處理費:若因旅客要求變更或取消第三方預定而產生退款作業,除供應商收取的取消費用外,本公司將視情況酌收 每人每項變更 $50紐幣 之行政費。
  • 供應商主動取消:若第三方供應商因安全、天氣、意外等不可抗因素取消服務,本公司將盡力為客戶安排替代方案,或將費用轉作其他活動之抵用金或退還給客戶。

行程安排

如遇交通延誤、惡劣天氣(如滑雪場因暴風雪關閉)、道路封閉等不可控因素,本公司保留調整行程或住宿地點之權利,但不承擔因變更產生的額外費用或損失。行程變更前導遊將與客戶充分協商,並以安全為首要原則。

 

守時

客戶應準時抵達指定地點並遵守導遊引導。若因個人遲到、擅自脫隊或違反規範導致錯過行程、受傷或財物損益,由旅客自行負責,本公司不予賠償或退款。

風險聲明
客戶了解參與本公司行程(如滑雪、山區活動)具備潛在不可預見風險,包括但不限於運動傷害、環境天候導致之不適、動物行為或交通意外。客戶確認已充分了解並自願承擔上述風險,且須全程遵守安全規定。隨行監護人應負起監管未成年旅客之全責。

安全
若本公司判定任何人士之行為,如受酒精/藥物影響,經勸阻仍進行危險行為等可能危害自身或他人,本公司保留立即終止其行程、拒絕其參與活動且不予退款之權利。

 

健康聲明
客戶有義務誠實告知足以影響活動安全之健康狀況(如病史、服藥狀況等);如因隱瞞導致意外,相關醫療費用由旅客自理。

 

保險建議

本公司強烈建議旅客於行程前自行投保全額旅遊不便險與意外險,如有滑雪行程保障內容應特別涵蓋「滑雪/雪地活動」之醫療補助、行程中斷、以及個人財物損壞/損失之理賠,以轉嫁因意外產生之高額經濟負擔。

 

投訴處理
若對旅程有任何不滿,請即時向導遊提出。若未能即時解決,應在旅程結束後 30 天內以書面形式提交至本公司官方信箱。

 

影像使用同意
為記錄旅程點滴,活動期間本公司可能會進行攝影或錄影。旅客同意本公司可將相關素材(含影像、聲音)用於活動回顧、品牌推廣或行銷用途(包含但不限於官網、Instagram、Facebook、Threads 等平台),且無需支付額外酬勞。若旅客不希望個人影像被公開使用,請於行程開始前以電子郵件告知,或口頭告知導遊,我們將予以配合。

 

修改權利與法律適用
本公司保留修改本條款之權利,更新版本公布即生效。本條款受紐西蘭法律管轄,任何爭議均適用紐西蘭法律,雙方同意以紐西蘭法院為第一審管轄法院。本合約之英文版本與中文版本如有歧義,以英文版本為準。

Terms and Conditions of Service


Legal Entity and Trading Name

This agreement is entered into between the Customer and Kea Travel Limited (trading as Kiwi Explorer), a company registered in New Zealand, hereinafter referred to as "the Company." All services provided under the Kiwi Explorer brand are managed by and remain the legal responsibility of Kea Travel Limited.


1. Consumer Guarantees

Where the Customer acquires services as a consumer for personal, domestic, or household use, they are protected by the New Zealand Consumer Guarantees Act 1993 (CGA). Nothing in this agreement is intended to limit, negate, or alter the rights of a consumer under the CGA. Both parties agree that the CGA shall not apply if the services are acquired for business purposes.


2. Agents

If this agreement is signed by an agent on behalf of the Customer, both the agent and the Customer shall be jointly and severally liable for all costs and fees. The agent is responsible for ensuring the Customer understands and accepts all terms of this agreement.


3. Booking and Payment

A deposit and a signed copy of this agreement are required to confirm a booking. The remaining balance must be paid in full no later than 60 days prior to the departure date. Failure to complete payment by the due date may result in the cancellation of the booking and forfeiture of the deposit. For bookings made within 60 days of departure, 100% of the total fee is due at the time of booking.


4. Payment Methods

Payments may be made via New Zealand Dollar (NZD) Bank Transfer or Credit Card.

l Bank Transfer: All transaction fees, including intermediary bank charges, shall be borne by the Customer.

l Credit Card: An additional 2.5% surcharge applies.

 

5. Tour Fees

The Company reserves the right to adjust tour fees in the event of uncontrollable increases in travel costs (e.g., fuel prices, changes in government taxes, or significant currency fluctuations) that exceed the Company's absorbable limits.

 

6. Cancellation and Refund Policy

Customer Cancellation

Fees are calculated as a percentage of the total tour price based on the date the written notice is received (New Zealand Time):

  • 60 days or more before departure: Full refund, less an administrative fee of NZD $150 per person and any transaction fees.
  • 30-59 days before departure: 50% refund of the total tour fee, less an administrative fee of NZD $150 per person and any transaction fees.
  • 29 days or less before departure: No refund will be provided.


Refund Processing

Refunds will be processed according to the original payment method after deducting administrative fees:

  • Credit Card: Transaction fees charged by the platform (approx. 2.9% - 3.6% depending on the card type) are non-refundable and will be deducted from the "Net NZD Amount" received by the Company.
  • International Transfer: Refunds will be issued in NZD. Any bank fees incurred during the transfer are the responsibility of the Customer.
  • Currency Exchange: Refunds are settled in NZD. The Company is not liable for any losses due to exchange rate fluctuations. Refunds will be completed within 14 business days of receiving a formal cancellation request.

 

7. Force Majeure and Company Cancellation

  • Force Majeure: If the itinerary cannot proceed due to natural disasters, extreme weather, pandemics, flight cancellations, or other unforeseeable events, the Company will assist the Customer with rescheduling, transferring to another tour, or applying for a refund.
  • Company Cancellation: The Company will notify Customers at least 60 days prior to departure if a tour is cancelled (e.g., due to failing to meet minimum group numbers). In such cases, a full refund of paid fees will be issued. The Company is not liable for external losses, including but not limited to airfare, visas, or insurance.

 

8. Third-Party Bookings

For additional services booked by the Company (e.g., accommodation, car rentals, lift passes, activities):

  • Supplier Terms Apply: Cancellations and refunds are strictly subject to the official policies of the third-party provider.
  • Non-refundable Items: Many ski-related bookings (e.g., lift passes or peak-season accommodation) are non-refundable and non-transferable once confirmed.
  • Administrative Fee: A fee of NZD $50 per person per change may be charged by the Company for modifications or cancellations requested by the Customer, in addition to any supplier fees.
  • Supplier Cancellation: If a supplier cancels due to safety or weather, the Company will endeavour to arrange alternatives, provide credits, or facilitate a refund where possible.

 

9. Itinerary Adjustments

The Company reserves the right to adjust itineraries or accommodation due to traffic delays, adverse weather (e.g., ski resort closures due to blizzards), or road closures. The Company is not liable for additional costs or losses arising from such changes. Decisions will be made in consultation with the Customer, with safety as the primary priority.

 

10. Punctuality

Customers must arrive at designated locations on time and follow the guide's instructions. The Company is not liable for missed itineraries, injuries, or property damage caused by tardiness, unauthorized deviation from the group, or failure to follow regulations. No refunds will be provided in such cases.

 

11. Risk Disclosure

The Customer acknowledges that participating in the Company's activities (e.g., skiing, alpine activities) involves inherent and unforeseeable risks, including but not limited to falls, sports injuries, traffic accidents, property loss, human error (e.g., communication gaps or physical limitations), animal behaviour, and illness caused by harsh weather. Customers must follow all safety instructions and wear appropriate safety gear. Guardians must ensure minors strictly adhere to all safety regulations.

 

12. Safety and Conduct

The Company reserves the right to immediately terminate the itinerary of any individual whose conduct (e.g., under the influence of alcohol/drugs or engaging in dangerous behaviour despite warnings) poses a threat to themselves or others. No refund will be provided.

 

13. Health Declaration

Customers are obligated to honestly disclose any health conditions (e.g., medical history, medication) that may affect safety. If an incident occurs due to non-disclosure, the Customer shall be solely responsible for all related medical and rescue costs.

 

14. Insurance Recommendation

The Company strongly recommends that Customers obtain comprehensive travel insurance prior to the trip. Coverage should specifically include medical expenses for "Skiing/Snow Activities," trip interruption, and loss or damage to personal property.

 

15. Complaints and Dispute Resolution

Any dissatisfaction during the trip should be reported immediately to the guide. If the issue remains unresolved, a written complaint must be submitted to the Company’s official email within 30 days of the trip's conclusion.

 

16. Media Consent

The Company may take photographs or videos during activities for record-keeping and promotional purposes. The Customer consents to the use of such materials (including image and voice) for brand marketing on platforms including but not limited to the official website, Instagram, Facebook, and Threads, without compensation. If you do not wish to have your image used publicly, please notify the Company via email prior to the trip or inform your guide in person.

 

17. Amendments and Governing Law

The Company reserves the right to modify these terms; updates are effective upon publication. This agreement is governed by the laws of New Zealand. Both parties submit to the exclusive jurisdiction of the New Zealand courts. In the event of any discrepancy between the English and Chinese versions of this agreement, the English version shall prevail.

 

IMPORTANT DECLARATION

By paying the deposit, you acknowledge that you have read, understood, and fully agreed to the above Terms and Conditions.
